Steps to Take After an Automobile Collision

February 20, 2015, on Articles |

Despite the fact that automobile accidents occur on a daily basis in Florida and throughout the country, many people still do not know what they should do after an accident occurs, particularly if those involved in the collision have never been in an accident before. Most accident attorneys will tell you there are a number of steps people should take to protect themselves and ensure proper handling of the case should the need arise to pursue litigation in the future.

Step #1: Contact Law Enforcement and Seek Medical Assistance

One of the first things an accident victim should do is seek medical attention if anyone in the vehicle has sustained injuries. All too often, those involved in accidents sustain minor injuries and do not believe they need medical attention. However, it is not uncommon for injuries to reveal themselves weeks or months after a collision. That is why it is imperative for accident victims to get checked by a medical professional as soon as possible, even if they “feel fine.”

Once those in need of medical treatment have been tended to, someone involved in the accident should contact the police. Law enforcement presence is crucial, as they will create the official accident report that can be used to file an insurance claim or pursue litigation and compensation for their injuries and damages.

Step #2: Document as Much as Possible About the Accident

It is also important for accident victims to retain as much information as possible about what took place just prior to, during and right after the accident occurred. To do this, accident victims who are not significantly injured should immediately jot down notes regarding what happened and take pictures with a cell phone or camera, if available.

Additionally, if there were witnesses to the collision, their contact information should be obtained just in case they are needed to corroborate certain facts of the case. It is also crucial to gather contact information, including names, addresses, phone numbers, license plate numbers and insurance information from all motorists involved in the accident.

Step #3: Keep Your Mouth Shut and Contact an Attorney

Sometimes, those involved in accidents will be so shaken they will ramble on about what they believe happened and how sorry they are (if they believe they were at fault). However, if you are in an accident, do not speak to anyone about what occurred, except law enforcement and/or your lawyer. Even when speaking with the police, only answer the questions asked and do not volunteer information.

Most importantly, do not admit guilt to anyone and do not speak to another party’s insurance company. Accident victims are encouraged to reach out to skilled personal injury attorneys as soon as possible after an accident to obtain proper advice as to their legal rights and options.

Help is Available While You Await an Outcome

Litigation and even settlements can take months or sometimes years to resolve. During that time, injured individuals may experience difficulty meeting their monthly financial obligations, particularly if they have been hurt so badly that they cannot work. If that is the case, there are many options available. Some may seek what is often referred to as a lawsuit loan* or pre-settlement funding. Lawsuit loans, which are not loans in the traditional sense, can provide assistance to those who need it most.
